3. Property Owner Responsibilities

As a property owner using our services, you agree to:

  • Provide accurate and complete information about your property
  • Maintain adequate property insurance
  • Comply with all applicable federal, state, and local laws
  • Authorize TPG Management to act on your behalf in property management matters
  • Pay management fees and other charges as outlined in your agreement
  • Provide timely responses to requests for decisions or approvals
  • Maintain the property in compliance with all housing codes and regulations

4. Tenant Responsibilities

As a tenant in a TPG Management property, you agree to:

  • Provide accurate information on rental applications
  • Pay rent on time according to your lease agreement
  • Maintain the property in good condition
  • Report maintenance issues promptly
  • Comply with all lease terms and property rules
  • Allow access for inspections and repairs as required
  • Respect neighbors and community standards

5. Fees and Payment Terms

Property Management Fees:

  • Management fees are calculated as a percentage of rent collected
  • Leasing fees apply for new tenant placements
  • Additional fees may apply for specific services as outlined in your agreement
  • All fees are detailed in individual management agreements

Tenant Payments:

  • Rent is due on the date specified in your lease agreement
  • Late fees apply as outlined in your lease
  • Payment methods are specified in your lease agreement

6. Termination of Services

Property Owners:

  • Management agreements may be terminated according to the terms specified in your contract
  • Written notice is required as outlined in your agreement
  • Final accounting and transfer of records will be provided upon termination

Tenants:

  • Lease termination is governed by your lease agreement and New Jersey law
  • Proper notice must be provided as required by your lease
  • Move-out procedures must be followed as outlined in your lease

7. Limitation of Liability

TPG Management strives to provide excellent service but cannot be held liable for:

  • Acts or omissions of tenants, contractors, or third parties
  • Property damage beyond our reasonable control
  • Market conditions affecting rental rates or vacancy periods
  • Losses resulting from force majeure events
  • Decisions made with owner approval or within granted authority

Our liability is limited to the extent permitted by law and as outlined in individual management agreements.

8. Website Use and Intellectual Property

Acceptable Use:

  • You may use our website for lawful purposes only
  • Do not attempt to gain unauthorized access to our systems
  • Do not transmit harmful code, viruses, or malicious software
  • Do not use our website to harass, defame, or harm others

Intellectual Property:

  • All content on our website is owned by TPG Management or our licensors
  • You may not reproduce, distribute, or create derivative works without permission
  • TPG Management logos, trademarks, and branding are protected

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

10. Fair Housing Compliance

TPG Management is committed to compliance with all fair housing laws, including:

11. Dispute Resolution

Informal Resolution:

Mediation:

If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing litigation.

Governing Law:

These Terms of Service are governed by the laws of the State of New Jersey. Any legal action must be brought in the appropriate courts of New Jersey.

12. Indemnification

You agree to indemnify and hold harmless TPG Management, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms of Service
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Your use of our services or website

13. Emergency Situations

TPG Management is authorized to take immediate action in emergency situations that threaten property or safety, including:

  • Arranging emergency repairs
  • Entering properties when necessary
  • Coordinating with emergency services
  • Incurring reasonable expenses to prevent further damage

Property owners will be notified as soon as reasonably possible.

14. Modifications to Terms

TPG Management reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date.

Continued use of our services after modifications constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and any individual management or lease agreements, constitute the entire agreement between you and TPG Management regarding the use of our services.
